Have spoken to a Solicitor this morning re our ongoing battle with Peugeot, Warwick Wright Brent Cross, Camdens and Black Horse.

They advised that you cannot reject an item after 3 months as you are deemed to have accepted it. Has anyone else been told this?

We saved all our problems until the six month service as advised by Warwick Wright Brent Cross at the time of purchase. I think this is an unscrupulous ploy by Peugeot & its dealers to avoid rejection!

Anyway, the Solicitor said we had a good case for compensation, but at an extortionate hourly rate!

Any help?

Complete and utter nonsense.

There is no set time after which goods (or services) are deemed to have been accepted.

If a car develops a problem, or has a problem that becomes apparent, only after a year then the problem was latent or hidden. The buyer can reject the goods but must do so as soon as the problem becomes apparent.

You may have a problem in that you didn't reject immediately but waited unitl the service. If you can show that you were told to wait by Peugeot, however, you may still be ok.

I am aware of the 'Latent Defect' principle from my work in the construction industry. If a Contract is under seal, we can be liable for up to 20 years!

Fortunately, Warwick Wright Brent Cross did write to us to remind us of the 6 month service and stated that it was an opportunity to sort out 'teething troubles'.

Although we did not take it to them for the 6 month service, it is them as the supplying dealer that we are trying to reject through.
