Tricky one this one.
Brought on E-bay yesterday a item,won the bidding at £190.
Cool i thought,good price,free P&P so i was happy.
Then get mail from the seller saying they had been having problems with e-bay(they did send me a copy of e-bay mail to confirm this). The problem was that they were unable to access their account so got someone else to put item on for them,this person forgot to put a reserve on of £230.
now,should i give them £215 as they want or £190 as i won bidding and do i leave feedback.
I think im in the right here,but as i said in title,its tricky.

Depends how badly you want the item!
I think you're in the right too and the person who placed the item on e-bay forgetting to state the reserve should cough up the difference.
The seller should probably accept the £190 as nobody outbid you before so it's not certain that he'd get the reserve anyway.
If you'd been outbid would you have gone to £230?
Or you could compromise and agree to pay the P&P - unless you've gone and bought a stuffed elephant, of course

As a semi veteran of Ebay (280 ebays) its entirely the sellers mates fault (if there is one and its not the guy trying to get more out of you and believe me this happens LOTS :x ). You have entered a contract to buy said item for said price including P&P. The mate should take the blame for not setting up the auction correctly.
If the item is rare or you really must have it then I'm afraid you will have to shell out more. Ebay will protect you but it will only cause the guy to lose his ebay account they cannot force him to give the item.
If you can get another one then walk away, the seller will have lost £5 and will have to start again.

You're buying off the person who put it up on e-bay. He's the seller. It's really up to you how you go about the deal afterwards, but I'd say you won the auction, you are leagally bound to buy the thing at the agreed price.
I don't know where the seller stands leagally (as I haven't sold anything so haven't checked on the rights).
Problem is you need to avoid negative feedback. Maybe you should email ebay's customer service for advice before you continue the transaction. They may be able to stop you getting -ve feedback for this user at least if you back out.

I think he is a cheeky prat and you should not pay the money.
They will have checked out how it was doing during the week and should have realised that there was no mention of a reserve. It is then that they should have changed their listing not after it has ended.
The trouble is you may get negative feedback so you might want to contact ebay first.
I defo would not pay the full price it would stick in my throat too much. I would also name and shame the greedy ****.

when you look at it, £190 was the top bid and no one was paying anymore so the £230 reserve should be irrelevant as it would not have met the reserve.
my view would be the item costs £190 or the transaction is forgotten - that way you don't pay anymore than you intended and the seller does not need to sell for less than they wanted.
the seller loses out marginally by way of ebay fees - but i would say that was fair ?

If they were so desperate to get the item on Ebay and not wait a day or two for the problem to be resolved then stick with the £190 bid. Hopefully whoever it is will learn a lesson to wait a little while to post their items in future if they are having account problems, also they could have checked at some point during the auction to ensure everyhthing was done correctly.
Obviously they haven't done this and internet enabled computers aren't that difficult to come by in this day in age to load your own items on if your computer is goosed.

Thanks boys and girls for your help and advice.
I decided at the w/end to let the matter drop,brought same item for bit cheaper on net so im happy,sent this person a mail saying lets just forget the whole thing.
Then i spot he is now offering the same item on e-bay at a buy now price of £210,thats CHEAPER than what they wanted from me.
What a muppet,remind me never to deal with northerners again,waste of time.

Sounds like the person could loose out as a result of their own greed if the difference is only £20, the sale still has to go through, if it sells.
I think there is grounds for complaint as bumping up the price for whatever reason after the auction ends is clearly against e Bay rules. I also don't think you were treated well be either party, but hey, common sense has prevailed, it seems wise to walk away and avoid them negging you for what is a fairly trivial dispute.

You need to ask yourself the folllowing.
When you place your bid you are bound to a contract that says you are willing to pay x for this item.
If at the end of the item you did not want to pay x would the seller let you off? (I DONT THINK SO) :rolleyes:
